32 Referral of complaint to complaints entity
(1) If a complaint is made to the Ombudsman about a matter that could be the subject of a complaint under an Act to a complaints entity, the
Ombudsman:
(a) if the complaints entity is the Children's Commissioner and the complaint does not relate to a matter mentioned in section 24(1)(b) of the Children's Commissioner Act 2013 – must refer the complaint to the Children's Commissioner; or
(b) otherwise
– may refer the complaint to the complaints entity.
(2) The
Ombudsman must give written notice of the referral to:
(a) the complainant; and
(b) the public authority the subject of the complaint; and
(c) if the Ombudsman has given notice under section 47 to the responsible
Minister – that Minister.
