90 Offence to fail to comply with demand

(1)

A person who fails to:

(a) return an overdue book or material within 14 days of receiving the librarian's letter of demand under by-law 87; or

(b)

within one month after receiving a demand under by-law 89:

(i) pay the amount of costs specified in the demand for replacing or repairing a lost or damaged book or material; or

(ii) enter into an arrangement satisfactory to the council to satisfy that demand,

commits an offence.

Penalty: $3 000 and, in addition, $100 for each day during which the offence continues after the first day on which the offence is committed.

(2)

An offence against clause (1) is a regulatory offence.
