117AAD Alternative verdict
In a proceeding against a person charged with an offence against a provision specified in the following Table, column
1 (the prosecuted offence), the trier of fact may find the person not guilty of the prosecuted offence but guilty of an offence against a provision specified in the
Table as an alternative offence for the prosecuted offence (the
alternative offence) if the trier of fact:
is not satisfied beyond reasonable doubt that the person committed the prosecuted offence; and
is satisfied beyond reasonable doubt that the person committed the alternative offence.
