35 Existing works protected
(1)
A person does not contravene a planning scheme only by continuing existing works (whether or not to completion) after the commencement of a conflicting provision.
(2)
Existing works and any building constructed as part of those works may be used for the purpose for which they were constructed.
(3)
Sections 57 and 59 do not apply to a development permit that relates to existing works.
(4)
In this section:
conflicting provision means a provision of a planning scheme, or an amendment of a provision of a planning scheme, with which existing works conflict.
