77B Exception to show cause process
(1)
Despite section 77A, a consent authority may issue an enforcement notice without first giving a show cause notice under that section if the consent authority believes on reasonable grounds that it is not appropriate in the circumstances.
(2)
Without limiting the generality of subsection (1), the grounds for not first giving a show cause notice include preventing the following:
(a)
the clearing of native vegetation;
(b)
an irreversible change to the landscape;
(c)
the risk of material environmental harm;
(d)
the risk of significant adverse effect on amenity or public health.
