116G Protection from liability for use of police dog or police horse
A member of the Police Force is not civilly or criminally liable if a police dog or police horse, while being used by the member in good faith in the exercise of a power or performance of a function as a member:
comes into physical contact with a person or a person's clothing;
or
causes damage to a thing.
Example of physical contact for subsection (1)(a)
Restraining, pushing, biting or kicking a person.
Subsection (1) does not affect any liability the Territory would, apart from that subsection, have for the act of the dog or horse.
A member of the Police Force or the Territory is not civilly or criminally liable merely because a police dog or police horse entered or was at a place.
In this section:
exercise, of a power, includes the purported exercise of the power.
performance, of a function, includes the purported performance of the function.
