147FO Failure to comply with disease test order
(1)
A person commits an offence if:
(a)
the person is the third party for a transferor; and
(b)
a disease test order is made for the transferor; and
(c)
the person fails to take all reasonable steps to enable the taking of the blood sample in accordance with the order.
Maximum penalty: 100 penalty units.
(2)
An offence against subsection (1) is an offence of strict liability.
(3)
It is a defence to a prosecution for an offence against subsection (1) if the defendant has a reasonable excuse.
