25 Sale by Public Trustee
A sale by the Public Trustee in the exercise of his or her powers of sale under a mortgage may be by public auction or private treaty and, in the case of a sale by private treaty, advertising shall not be necessary.
Any money expended by the Public Trustee in the exercise of the powers of the Public Trustee under a mortgage shall be:
repayable to the Public Trustee by the mortgagor on demand and until repayment may, at the discretion of the Public Trustee, incur interest chargeable at the maximum rate provided by the mortgage, such interest (if any) to be computed from the date or dates of the money being expended; and
a charge on the mortgagor's interest in the land, the subject of the mortgage, and shall be secured by the mortgage.
