22 When drug screening test or oral fluid analysis may be required

(1)

An authorised person may require a rail safety worker to submit to a drug screening test or oral fluid analysis (or both):

(a)

on a random basis – without suspecting the worker has a prohibited drug in his or her body; or

(b)

on a non-random basis – in either or both of the following circumstances:

(i)

the authorised person suspects, on reasonable grounds, that the worker has a prohibited drug in his or her body;

(ii)

a prescribed notifiable occurrence happens involving the worker.

(2)

Subsection (1) is subject to sections 23 and 24.
