60 Local Court may make fortification removal order
(1) At the hearing of an application for a fortification removal order, the Local Court must:
(a) if it determines there is a ground for making a fortification removal order and it is appropriate to do so – make a fortification removal order; or
(b)
if it determines otherwise – dismiss the application.
(2) The fortification removal order may be made on an application made without notice to any person.
(3) Despite anything to the contrary in the Local Court (Criminal Procedure) Act, a decision of the Local Court under subsection (1)(a) cannot be appealed.
