49E Conduct and determination of review

(1)

In reviewing a reviewable decision, the Commissioner:

(a)

may decide the procedures of the review; and

(b)

must comply with the rules of natural justice.

(2)

To decide the review, the Commissioner must:

(a)

affirm the reviewable decision; or

(b)

vary the reviewable decision; or

(c)

set aside the reviewable decision and substitute a new decision.

(3)

The Commissioner must decide the review:

(a) if the reviewable decision relates to a death benefit – within 30 days after the application is made; or

(b)

otherwise – within 90 days after the application is made.
