Supreme Court (Judges Pensions) Act 1980

In addition to any requirements in Division 135 of Schedule 1 to the Commonwealth Act, payment of a release authority lump sum must not have the effect that a pension recipient's entitlements under this Act are reduced below zero.

For subsection (1), the effect of a release authority lump sum on a pension recipient's entitlements is to be calculated after taking account of any of the following reductions to the recipient's entitlements:

a reduction after a commutation under section 3E;

a reduction resulting from action taken under section 16.
