27D Power to apply for covert search warrant

An authorised police officer may apply to a Supreme Court Judge for a warrant (a covert search warrant) to enter and search a place if the officer suspects or believes on reasonable grounds:

(a)

a terrorist act has been, is being, or is likely to be, committed; and

(b)

the entry to and search of the place will substantially assist in responding to or preventing the terrorist act; and

(c)

it is necessary for the entry and search of the place to be conducted without the knowledge of any occupier of the place.
