Effect of a personal interest
26 Effect of a personal interest
If a board member has a personal interest in a matter that is required to be disclosed under section 25:
the board member must not take part in any deliberation or decision of the Advisory Board about the matter; and
the board member must be disregarded for the purpose of constituting the quorum of the Advisory Board for the deliberation or decision; and
the quorum for the deliberation or decision is a majority of board members entitled to participate in the deliberation or decision.
Despite subsection (1), a failure by the board member to disclose the interest in the matter does not, on its own, invalidate any decision of the Advisory Board about the matter.
