29AAM Licence suspension for up to 24 hours
(1) This section applies if, for the purpose of having a sample of blood or saliva taken for analysis to determine if there is a prohibited drug in a person's body, the person is:
arrested under section 29AAF(4); or
taken to a hospital or health centre under section 29AAG.
(1A) Subject to the Regulations, a police officer may, before the person is released from custody or departs the hospital or health centre, give the person a notice under this section.
The notice has the following effect:
(a) the person's licence is suspended for the period commencing immediately on the person receiving the notice and ending not more than 24 hours later, as specified in the notice;
the person is disqualified from driving for the same period.
The notice must:
be in a form approved by the Commissioner; and
inform the person of the suspension and disqualification.
(3) A notice under this section cannot be challenged or reviewed in any court.
(4) A police officer who gives a person a notice under this section must provide details of the notice, and the person to whom it was given, to the Registrar without delay.
