105 Water supply and sewerage services infrastructure does not merge with land
(1)
An agreement between a licensee and the owner of land relating to the construction or installation of water supply infrastructure or sewerage services infrastructure on the land is to be taken to include agreement that ownership of the infrastructure is not affected by its affixation or annexation to the land.
(2)
Water supply infrastructure and sewerage services infrastructure referred to in subsection (1) may be dealt with and disposed of as personal property.
(3)
Subsection (1) is subject to any agreement in writing to the contrary.
