114 Licensees not liable in certain circumstances
(1)
A licensee, or an officer or employee of the licensee, is not liable for damages or any penalty arising out of a partial or total failure to supply water and sewerage services to a customer unless the failure is due to an act or omission done or made by the licensee or the officer or employee in bad faith or through negligence.
(2)
A licensee may enter into an agreement with a person varying or excluding the operation of this section and this section, to the extent of the agreement, does not apply.
