10.02 Litigation guardian

(1)

Except where provided otherwise by or under an Act, a person under a disability may commence or defend a proceeding only by his or her litigation guardian.

(2)

An application commencing a proceeding or an appearance filed by a litigation guardian is to state that the proceeding is commenced or defended by the litigation guardian on behalf of the person under a disability.

(3)

Except where these Rules provide otherwise, anything that is required or permitted by these Rules to be done by a party who is a person under a disability is required or permitted to be done by the party's litigation guardian.

(4)

If a party has a litigation guardian in a proceeding, no other person may act as the litigation guardian of that party unless the

Court orders otherwise.
