16.01 Manner of giving evidence
Evidence is to be given orally except:
(a) in an interlocutory application, where it is to be given by affidavit unless the Court orders otherwise;
(b)
if an Act or these Rules provide otherwise;
(c) if the parties agree that all or part of the evidence may be given by affidavit; or
(d)
if the Court orders otherwise.
