3.07 Notice of discontinuance or withdrawal
(1)
At any time before the date fixed for the hearing of a proceeding a party may, without the leave of the Court:
(a)
discontinue an application or counterclaim by filing and serving a notice of discontinuance; or
(b)
withdraw an appearance or notice of defence by filing and serving a notice of withdrawal.
(2)
A notice of discontinuance or withdrawal is to be in accordance with Form 3A.
(3)
Discontinuance or withdrawal is effective when the relevant notice has been filed and served.
