23 Appeal to Land Court against refusal to publish lease entitlement notice

(1)

This section applies if the chief executive refuses an application to publish a lease entitlement notice.

(2)

The applicant may appeal to the Land Court against the decision.

(3)

The appeal must be started within 28 days after the applicant is given notice of the chief executive’s decision to refuse the application.

(4)

The parties to the appeal are—

(a)

the applicant; and

(b)

the chief executive.

(5)

If the Land Court decides that the lease entitlement notice should be published, the Land Court’s decision must include the details of the lease entitlement to be included in the notice.

(6)

It is not necessary for the details mentioned in subsection (5) to be consistent in every respect with the details included in the application as dealt with by the chief executive.
