32 Application about statement of reasons (obstacles)
This section applies if—
a statement of reasons (obstacles) is currently in effect for a lease entitlement; and
the statement identifies practical obstacles; and
a person (the relevant person) claims that there are no practical obstacles to the grant of a lease to satisfy the lease entitlement; and
the relevant person is a proper applicant for the lease.
The relevant person may apply to the Minister for the statement of reasons (obstacles) to be amended to state that there are no practical obstacles to the granting of a lease to satisfy the lease entitlement.
The Minister may ask the relevant person for further information to support the application within a stated reasonable period.
The Minister must decide the application, and advise the relevant person of the decision, within—
28 days after the application was made; or
28 days after the application was made together with any time the Minister reasonably requires to deal with additional information given by the applicant.
The Minister may decide the application if the applicant does not provide additional information within the stated period.
