147 Beneficiary to home ownership lease

(1)

A person who is beneficially entitled under a will to a home ownership lease may ask the lessor—

(a)

to give the person a notice stating whether or not the person is entitled to a grant of the lease under this Act; and

(b)

if, under a condition of the lease, the lease can not be transferred without the lessor’s written consent—for the lessor’s written consent to the transfer of the lease.

Note—Under section 122, a home ownership lease may include a condition that it must not be transferred without the lessor’s prior written consent.

(2)

The lessor must comply with a request under subsection (1) as soon as practicable after receiving the request.
