17 Notice of intention to make declaration

(1)

If the Minister intends to make a declaration under section 16, the Minister must—

(a)

give notice of the Minister’s intention to make the declaration to the trustee of the relevant land; and

(b)

as soon as practicable after giving the notice under paragraph (a), publish notice of the Minister’s intention to make the declaration in a newspaper or other publication circulating generally in the area where the relevant land is situated; and

(c)

consider all representations made under subsection (4).

(2)

The notice must—

(a)

include a description of the relevant land; and

(b)

state the following—

(i)

the reasons for the proposed declaration;

(ii)

that a person may make written representations to the Minister about the proposed declaration;

(iii)

the place where the representations may be made;

(iv)

the period in which the representations must be made.

(3)

The stated period must end at least 28 days after the notice is published.

(4)

A person may make written representations about the proposed declaration to the Minister within the stated period.
