257 Proposed removal or suspension approved by resolution and show cause notice
A land trust may, by resolution, decide to take action under this subdivision (the proposed action) to remove or suspend a member of the land trust because a ground exists for the removal or suspension.
However, members of the land trust must be given at least 14 days notice of the general meeting of the land trust at which the resolution is intended to be proposed.
If the land trust makes a decision under subsection (1), the land trust must—
refer the matter of the proposed action to the executive committee of the land trust to decide; and
give the member a notice (a show cause notice).
The show cause notice must state all of the following—
details of the resolution mentioned in subsection (1), including the date the resolution was made;
the proposed action;
the ground for the proposed action;
an outline of the facts and circumstances forming the basis for the ground;
if the proposed action is suspension of the member—the proposed suspension period;
that the member may, within a stated period (the show cause period), make written representations to the land trust to show why the proposed action should not be taken.
The show cause period must end at least 1 month after the show cause notice is given.
