Aboriginal Land Act 1991

This section applies to a lease that, immediately before the cancellation of the Mornington Shire lease under section 48(1), was a sublease of the Mornington Shire lease.

Note—The Mornington Shire lease was cancelled under section 48(1) when deeds of grant for all the Mornington Shire lease land took effect under section 44.

From the cancellation, the sublease is taken to have been, and is, continued in force as a lease under section 45 (as amended) with the trustee of the Aboriginal land as the lessor.

In this section—commencement means the commencement of the Land, Water and Other Legislation Amendment Act 2013, section 6.Mornington Shire lease see section 45(7).section 45 (as amended) means section 45, as in force immediately after the commencement.
