29 Legislative Assembly’s resolutions to be interpreted not to exceed authority
A resolution of the Legislative Assembly, or a committee of the Legislative Assembly, made under an Act is to be interpreted as operating—
to the full extent of, but not to exceed, the Legislative Assembly’s constitutional powers; and
subject to the Act; and
distributively.
Without limiting subsection (1), if part of a resolution would, apart from this section, be interpreted as exceeding authority—
the resolution is valid to the extent to which it does not exceed authority; and
the remainder of the resolution is not affected.
Without limiting subsection (1), if the application of part of a resolution to a person, matter or circumstance would, apart from this section, be interpreted as exceeding authority, the part’s application to other persons, matters or circumstances is not affected.
This section applies to an Act in addition to, and without limiting, any provision of the Act.
