General biosecurity obligation offence provision

In force

(1)

A person on whom a general biosecurity obligation is imposed must discharge the obligation.Maximum penalty—

(a)

if the offence is an aggravated offence—3,000 penalty units or 3 years imprisonment; or

(b)

if the offence is not an aggravated offence—

(i)

for a breach in relation to prohibited matter—1,000 penalty units or 1 year’s imprisonment; or

(ii)

for a breach in relation to restricted matter—750 penalty units or 6 months imprisonment; or

(iii)

otherwise—500 penalty units.

(2)

If the offence is not an aggravated offence, it is a defence for the person to show that the person had a reasonable excuse for failing to discharge the obligation.
