Production or display of identity card
22E Production or display of identity card
In exercising a power under this Act in relation to another person, an inspector must—
produce the inspector’s identity card for the other person’s inspection before exercising the power; or
have the identity card displayed so it is clearly visible to the other person when exercising the power.
However, if it is not practicable to comply with subsection (1), the inspector must produce the identity card for the other person’s inspection at the first reasonable opportunity.
For subsection (1), an inspector does not exercise a power in relation to another person only because the inspector—
has entered a place that is a public place and entry is made when it is open to the public; or
for the purpose of asking the occupier of a place for consent to enter—
enters land around premises at the place to an extent that is reasonable to contact the occupier; or
enters part of the place the inspector reasonably considers members of the public ordinarily are allowed to enter when they wish to contact the occupier.
