132 Effect of building certifier not complying with Act if no penalty provided
(1)
This section applies if—
(a)
a building certifier does not comply with a provision of this Act about building or private certifying functions; and
(b)
no penalty is stated for the failure to comply.
Examples of provisions mentioned in subsection (1)—sections 48, 88, 102, 105, 127, 128, 137 and 139
(2)
The failure to comply is not an offence.
(3)
For the definition of unsatisfactory conduct in schedule 2, the failure is taken to be conduct that is contrary to a function under this Act.
