The chief executive must, in response to a request made by a potential claimant and as soon as reasonably practicable after the request is received, give the potential claimant the information the chief executive is reasonably able to give about—

the relevant award; and

the amount of the victim trust fund; and

any other victim claims against the person in relation to whom the relevant money was awarded that may be payable from the victim trust fund and of which the chief executive has been given notice under section 319X(5).

The giving of information under subsection (1)—

is allowed despite an agreement to which the protected defendant liable to pay the relevant award is a party that would otherwise prohibit or restrict the disclosure of information about the relevant award; and

is not a contravention of the agreement.

However, the giving of information under subsection (1) must not include the giving of someone else’s personal information, unless that person has given written consent to its giving.

A potential claimant to whom information is given under subsection (1) must not disclose the information to someone else other than—

for the purpose of obtaining legal advice or representation, or for a proceeding, relating to a victim claim by the potential claimant against the person in relation to whom the relevant money was awarded; or

as required by law; or

for information that is personal information of someone else—with the consent of that person.

Maximum penalty—50 penalty units.

In this section—personal information, of a person, means the person’s name and address, or other information that may identify the person.
