Corrective Services Act 2006

This section applies to an interstate prisoner who is in Queensland under a corresponding interstate leave permit.

If the interstate prisoner escapes from custody, the prisoner may be arrested without warrant by the prisoner’s interstate escort, a police officer or someone else.

If the interstate prisoner has escaped and been arrested, or has attempted to escape, the prisoner may be taken before a magistrate.

Despite the terms of the corresponding interstate leave permit, the magistrate may, by warrant, order the interstate prisoner—

to be returned to the participating State; and

to be delivered to an interstate escort.

The warrant may be executed according to its terms.

The interstate prisoner mentioned in the warrant may be detained as a prisoner of the State—

for 14 days after the warrant is issued; or

until the prisoner is delivered into the custody of an interstate escort, if that happens before the end of the 14 days.

If the interstate prisoner is not delivered into the custody of an interstate escort within 14 days after the warrant is issued, the warrant ceases to have effect.
