437 Hearing—offence
(1)
On the hearing of an application under section 436(1)(a) to set aside a conviction for the offence, the Supreme Court may—
(a)
set aside the conviction; or
(b)
confirm the conviction.
(2)
The court may have regard to any material relevant to the application.
