99 Appeal
(1)
Within 28 days after either of the following happens, the authorised commission officer may appeal against the order to the Supreme Court—
(a)
a magistrate refuses to make a post-search approval order;
(b)
a magistrate makes an order under section 98(2).
(2)
If the authorised commission officer appeals, the officer must retain any thing seized until the appeal is decided.
(3)
The court may make an order under section 118 or 119, whether or not the appeal is upheld.
