Powers of the court
146 Powers of the court
Subject to sections 147 and 148, the Court of Disputed Returns may make any order or exercise any power in relation to the application that the court considers just and equitable.
The orders may include any of the following—
an order to the effect that the person elected is taken not to have been elected;
an order to the effect that a new election must be held;
an order to the effect that a candidate other than the one elected is taken instead to have been elected;
an order to dismiss or uphold the application in whole or part.
To remove doubt, it is declared that the court may order the opening of a sealed declaration vote envelope.
However, the court must ensure, as far as is reasonably practicable, the secrecy of the ballot is maintained.
