175 Failure to enrol etc.
Subject to this section, a person who contravenes section 65(2) or (3) commits an offence punishable on conviction by a penalty of a fine of not more than 1 penalty unit.
Subject to this section, if a person who is entitled to be enrolled for an electoral district is not enrolled for the electoral district—
at the end of 21 days after becoming entitled; or
at any later time while the person continues to be entitled to be enrolled for the district;
the person commits an offence punishable on conviction by a penalty of a fine of not more than 1 penalty unit.
If the person admits evidence that the non-enrolment was not because of the person’s failure to give notice as required by section 65(2), the person does not commit an offence against subsection (2) unless the prosecution proves the contrary.
If a person gives notice as required by section 65(2), a proceeding must not be instituted against the person for an offence against subsection (1) for a contravention of section 65(2), or for an offence against subsection (2), committed before the notice was given.
