269 Duty to preserve incident or event sites
This section applies if a serious electrical incident or dangerous electrical event happens at a place.
The person with management or control of the place must ensure, so far as is reasonably practicable, that the site where the incident or event occurred is not disturbed until an inspector arrives at the site or any earlier time that an inspector directs.Maximum penalty—100 penalty units.
A person must not move or otherwise interfere with any electrical equipment, or part of any electrical equipment, involved in the happening of the incident or event.Maximum penalty— 40 penalty units.
Subsections (2) and (3) do not prevent any action—
to assist an injured person; or
to remove a deceased person; or
that is essential to make the site safe or to minimise the risk of a further serious electrical incident or dangerous electrical event; or
that is associated with a police investigation; or
of a person acting under the authority of the distribution entity for the incident or event; or
for which an inspector or the regulator has given permission.
In this section—
site, where a serious electrical incident or dangerous electrical event occurs, includes any plant, substance, structure and thing associated with the incident or event.
