Stay of operation of decision etc.
210 Stay of operation of decision etc.
If an application is made under this part for internal review of a decision, the applicant may immediately apply, as provided under the QCAT Act, to QCAT for a stay of the decision.
QCAT may stay the decision to secure the effectiveness of the internal review or a later application for external review to QCAT.
A stay—
may be given on conditions QCAT considers appropriate; and
operates for the period fixed by QCAT; and
may be revoked or amended by QCAT.
The period of a stay under this section must not extend past the time when QCA reviews the decision and any later period QCAT allows the applicant to enable the applicant to apply for an external review of QCA’s decision.
The making of an application under this part for internal review of a decision affects the decision, or the carrying out of the decision, only if the decision is stayed.
