362 When environmental enforcement order may be issued
The administering authority may issue an order (an environmental enforcement order) to a person if the authority believes an enforcement ground exists for the person.
Also, the administering authority may issue an environmental enforcement order to a person—
whom the authority believes to be a prescribed person for a contamination incident; or
in the circumstances stated in division 4.
To remove any doubt, it is declared that the administering authority may issue an environmental enforcement order to a person in relation to an activity even if the person is the holder of an environmental authority that authorises, or purportedly authorises, the activity.
