146W Provisions applying for particular proceedings
This section applies for sections 146L, 146M, 146O, 146Q and 146R (each the section).
A person causes something mentioned in the section if the person’s act or omission is a substantial or significant cause of the thing or substantially contributes to the thing.
The section applies despite the Criminal Code, sections 23(1) and 24.
It is a defence in a proceeding against a person for a contravention of the section for the person to prove the person took reasonable precautions and exercised proper diligence to prevent the contravention.
Also, it is a defence in a proceeding against a person for a contravention of the section for the person to prove the contravention was due to causes over which the person had no control.
