152C Inspection of records of local governments and building certifiers
A person authorised by the commissioner for this section (the authorised person) may, during ordinary business hours, enter premises in which a local government or building certifier carries on business.
At the premises, the authorised person may—
make inquiries for the purpose of this Act; and
examine, make copies of or take extracts from a document or record relating to—
if the premises are premises in which a local government carries on business—a function of the commissioner or of the local government under this Act; or
if the premises are premises in which a building certifier carries on business—something done by the building certifier under the Building Act 1975, the repealed Integrated Planning Act 1997, the repealed Sustainable Planning Act 2009 or the Planning Act 2016.
However, the authorised person may only examine, make copies of or take extracts from a document or record under subsection (2)(b)(ii) if the document or record is not available from a local government.
A person who has control of a document or record of a type mentioned in subsection (2)(b), must, if required by the authorised person—
produce the document or record to the authorised person; or
give the authorised person information relating to the document or record; or
otherwise assist the authorised person.
Maximum penalty—10 penalty units.
Nothing in this section authorises an authorised fire officer to enter part of premises that are a dwelling if the part is not also a workplace within the Work Health and Safety Act 2011.
