In considering an applicant’s ability to perform the requirements of a position for the purpose of the Public Sector Act 2022, section 45(2)(a), the person undertaking the recruitment and selection process must consider whether the applicant has the mandatory qualifications, skills or experience the commissioner considers necessary for the position (the requisite conditions).

In deciding the applicant best suited to the position under the Public Sector Act 2022, section 45(2), the person must consider the primacy of the requisite conditions over any other matter that may be considered under section 45(2)(b) of that Act.
