181 Consent to entry
This section applies if an inspector intends to seek the consent of an occupier of a place to an inspector entering the place under this part.
This section also applies if an inspector intends to seek the consent of the owner or person in control of an unattended boat to an inspector entering a secured part of the boat under this part.
Before seeking the consent, the inspector must inform the occupier, owner or other person (the person)—
of the purpose of the search; and
that anything seized during the search may be used in evidence in court; and
that the person is not required to consent.
If the consent is given, the inspector may ask the person to sign an acknowledgement of the consent.
The acknowledgement must—
state the person was informed—
of the purpose of the search; and
that anything seized during the search may be used in evidence in court; and
that the person was not required to consent; and
state the person gave the inspector consent under this part—
to enter the place or secured part of the boat; and
to exercise powers under this Act; and
state the time and date the consent was given.
If the person signs an acknowledgement of consent, the inspector must immediately give a copy to the person.
