Fisheries Act 1994

This section applies to a fisheries development approval for the construction or raising of a waterway barrier works if conditions about either or both of the following are imposed on the approval—

the design or construction of a fish way for the waterway barrier works;

monitoring or operation of a fish way.

For the Planning Act, section 164, the maximum penalty for not complying with the condition is 2,000 penalty units.
