61C Entitlement under permit
A permit does not authorise a person to enter the surface of land of an owner that is—
within 200m laterally of—
a dwelling house, or other building (not of a temporary nature) on that land, principally used for accommodation of persons or the conduct of business; or
a building (not of a temporary nature) on that land used for community, sporting or recreational purposes or as a place of worship; or
within 100m laterally of—
a principal stockyard or a dam, bore or artesian well of that owner or other artificial water storage of that owner connected to a supply of water; or
a cemetery or burial place;
except with the written consent of the owner of the land lodged with the chief executive.
In this section—building means a fixed structure that is wholly or partly enclosed by walls and is roofed.dwelling house means a fixed structure that is wholly or partly enclosed by walls and is roofed.
