262 Removal of certain persons
A licensee may cause a person to be removed from, or refuse to allow a person to enter, the licensee’s licensed premises if the person—
breaches the rules for the licensed premises required to be displayed and enforced under section 237; or
damages or physically abuses a gaming machine; or
behaves in a way likely to cause offence to other persons; or
is suspected on reasonable grounds of being on the premises for the purpose of committing an offence or aiding another person to commit an offence against this Act.
A licensee must cause to be removed from the licensee’s licensed premises a person who is prohibited under section 258(2) from playing gaming machines on the premises if the person plays, or induces another person to play, a gaming machine on behalf of the first person.Maximum penalty—250 penalty units.
A licensee, or other person acting for a licensee, may use such force and assistance as are necessary and reasonable in removing a person from, or preventing a person from entering, the licensee’s licensed premises under subsection (1) or (2).
The force that may be used does not include force that is likely to cause bodily harm to the person.
