89 Matters to be taken into account for decrease proposal
This section applies to the commissioner in making a decision about a decrease proposal.
The commissioner must have regard to the decrease sought or recommended in the proposal.
Also, the commissioner may have regard to the following matters—
the public interest;
whether or not there are any other licensed premises in close proximity to the licensed premises to which the decrease proposal relates (the subject premises);
the interests of persons using the subject premises;
if the licensee of the subject premises is a category 2 licensee—
the interests of the members of the licensee; and
whether or not the members have indicated support for a decrease in the approved number of gaming machines for the premises.
