Requirements for making declaration
252 Requirements for making declaration
Generally, an insufficiency of supply declaration must be made by gazette notice.
However, the Minister may make an insufficiency of supply declaration by another document if the Minister is reasonably satisfied extraordinary circumstances require it to be made immediately.
If an insufficiency of supply declaration is made under subsection (2), the Minister must immediately publish the making of the declaration in the way the Minister considers most appropriate to notify persons likely to be affected by it.
A failure to comply with subsection (3) does not invalidate or otherwise affect the declaration.
