Deciding whether to grant GHG lease
130 Deciding whether to grant GHG lease
The Minister may, after the closing time for the call for tenders—
grant a GHG lease to 1 tenderer; or
refuse to grant any GHG lease.
However—
before deciding to grant the GHG lease, the Minister must decide whether to approve the applicant’s proposed initial development plan for the GHG lease; and
the Minister can not grant the GHG lease unless—
the tenderer is an eligible person; and
the proposed plan has been approved; and
the Minister is satisfied the requirements for grant other than the requirement mentioned in section 118(1)(c) have been complied with; and
a relevant environmental authority has been issued.
Note—
If a tender relates to acquired land, see also section 369C.
This section applies subject to section 121.
