Heavy Vehicle (Fatigue Management) National Regulation

The record keeper for a driver of a fatigue-regulated heavy vehicle may apply to the Regulator for a fatigue record keeping exemption (permit).

The application must—

be in the approved form; and

state the following—

the period for which the permit is sought;

any conditions for the permit sought by the applicant;

the name and details of each driver of a fatigue-regulated heavy vehicle to whom the permit is sought to apply.

The Regulator may, by notice given to the applicant, require the applicant to give the Regulator any additional information the Regulator reasonably requires to decide the application.

In deciding whether or not to grant a fatigue record keeping exemption (permit), the Regulator must have regard to the approved guidelines for granting fatigue record keeping exemptions.
